TWIGTALE PRIVACY POLICY

Kitabu LLC (“Kitabu,” “we” or “us”), a California limited liability company, is the owner and operator of www.twigtale.com (the “Twigtale Site”) and the purveyor of all services available or accessible through the Twigtale Site (collectively, the “Twigtale Services”). Your privacy is important to us, and we want you to feel secure when visiting the Twigtale Site and using the Twigtale Services. We created this Privacy Policy (the “Privacy Policy”) to explain what information we collect from you and how we use your information. The Privacy Policy, together with the Twigtale Terms of Use, which is expressly incorporated herein, governs your access and use of the Twigtale Site and Services. Please familiarize yourself with the following terms and conditions.

 BY UTILIZING THE TWIGTALE SITE OR TWIGTALE SERVICES AND/OR BY REGISTERING WITH US, YOU SIGNIFY THAT YOU AGREE TO THIS PRIVACY POLICY, INCLUDING THE TWIGTALE TERMS OF USE, WHICH IS INCORPORATED HEREIN BY REFERENCE.

1.  Information We Collect. 

We gather the following  types of information from visitors of the Twigtale Site and users of the Twigtale Services:  (i) In order for you to access certain areas of the Twigtale Site and use certain Twigtale Services, we may require you to register for an account (“Twigtale Account”) and provide us with certain information that is personally identifiable to you, like your name, address, email address, or phone number, as well as other non-public information that is associated with the foregoing (collectively, “Personal Information”);.  (ii) If you access the Twigtale Site without registering for a Twigtale Account, the only information we collect will be certain non-personal or anonymous information not associated with or linked to your Personal Information, such as demographic information, IP addresses, and any other information that does not reveal your specific identity (collectively, “Anonymous Information.”

A.  Personal Information.  In order for you to certain Twigtale Services, we may require you to register for a Twigtale Account. As part of the registration process, you will create a username and password. The username and password that you provide are your credentials (“Credentials”) for accessing those Twigtale Services that are only available to registered Twigtale members. A good password includes seemingly random letters and numbers, and isn’t obvious (as an example, we do not suggest using names of a spouse, child, or pet). You are responsible for keeping your Credentials confidential and for notifying us if they have been hacked or stolen. In order to register you will also be required to provide us with certain Personal Information, which may include your Credentials, first and last name, email address and telephone number. In connection with your use of certain Twigtale Services, you may also be required to certain additional Personal Information, such as your credit card information and shipping and billing address. You are responsible for ensuring the accuracy of all Personal Information you submit.  Inaccurate information may affect the information you receive when using the Twigtale Services and our ability to contact you as described in this Privacy Policy.

We use the Personal Information that you provide to better understand your needs and interests and provide you the specific Twigtale Services you select, including to process your orders and to communicate with you about Twigtale Site maintenance and updates, as appropriate.  You may choose not to provide us with any Personal Information. In such case, you will not be able to access and use those Twigtale Services that require your Personal Information. Subject to the Privacy Policy, if you contact us, we may use any of the information you submit in connection with your inquiry, or any Personal Information and Anonymous Information we have about you when responding to your inquiries.

B.  Anonymous Information.  When you visit the Twigtale Site and interact with the Twigtale Services, we may collect Anonymous Information from sources such as server log files, environmental variables, such as your MAC address, computer type (Windows or Macintosh), screen resolution, OS version, Internet browser, and Internet browser version, and from scanning navigational data in order to help us deliver a better  user experience.  Such Anonymous Information could include the web site you were on before coming to the Twigtale Site, IP addresses, or areas of the Twigtale Site being clicked on most frequently.  We and our suppliers (including providers of web analytics tools) may also use “cookies” as well as so-called “pixel tags,” “web beacons,” “clear GIFs” and other similar technologies to help us deliver better user experience and to facilitate your ongoing access to and use of the Twigtale Services.  Cookies are small data files stored by your web browser on your computer’s hard drive.  If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies, or to be given the choice of declining or accepting the transfer of a particular cookie, or cookies from a particular website, to your computer.    If you choose to reject all cookies, you may not be able to access certain Twigtale Services.

C.   Updating Your Personal Information.

You can update or delete any Personal Information associated with your Twigtale Account at any time by logging into your Twigtale Account and clicking on the “My Account Info” link or by contact us at the address provided in Section 8 of this Privacy Policy.

D.   Opt-Out.

You may unsubscribe to our notification services by contacting us at the address provided in Section 8 of this Privacy Policy.

E. California Residents.

Under California law, users of Twigtale Services who are residents of California may request certain information about our disclosure of Personal Information to third parties for their direct marketing purposes during the prior calendar year. California residents may request such information by contacting us at the address listed at the end of this Privacy Policy.

F. Children.

While certain books and other products available for purchase on/through the Twigtale Site are meant for young children, the online Twigtale Services are not intended for use by children under the age of thirteen (13).  We do not knowingly collect Personal Information from children under the age of thirteen (13).

3.  How We Use the Information We Collect

A. Personal Information.  We may use Personal Information to contact you when necessary, including to send you news about Twigtale Services, Twigtale Account registration verification emails, order confirmations, purchase receipts, surveys newsletters, special offers and in conjunction with your use of certain other Twigtale Services. We may share Personal Information with our business partners who assist us by performing core services related to our operation of the Twigtale Site and/or by making certain Twigtale Services available to our users (such as website hosting, payment processing, merchandise shipment, data storage and security). Those business partners shall be bound to uphold the same standards of security and confidentiality that we have promised to you in this Privacy Policy, and they will only use your Personal Information to carry out their specific business obligations. We do not share, sell, rent or trade your Personal Information with any third parties for their promotional purposes. In addition, we may transfer your Personal Information to another company in connection with a merger, sale or acquisition by or of Kitabu. In this event, we will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy. Lastly, we reserve the right to disclose your Personal Information as required by law and when disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process.

            B.  Anonymous Information.  We may use your Anonymous Information to customize and tailor your experience with the Twigtale Services and in emails to you displaying content that we think you might be interested in and according to your preferences. Because Anonymous Information does not personally identify you, we may use such information for any other purpose we deem appropriate in our sole discretion.

4. The Privacy of Your Submissions.

As part of the Twigtale Services, we may offer you the opportunity to upload, submit, post, publish, communicate, display, distribute or otherwise transmit text, images, graphics, audiovisual and/or other content (“Submissions”). The Twigtale Services are designed to give you the ability to control who may view your Submissions, and we will use our best efforts to restrict access to your Submissions in accordance with your preferences and this Privacy Policy; provided however, that we are not responsible for any inadvertent failure keep any Submission private. Please also note that if you choose to share a Submission with a third party via the “Twigtale Share” link or otherwise, said Submission may be accessible by other third parties in addition to the designated recipient and we have no control over, and are not responsible for, the privacy of any Submissions you voluntarily elect to  share. .

5.  Security.

We use industry-standard electronic means to help protect your Personal Information from unauthorized access, use, or disclosure.  We store Personal Information behind a computer firewall, a barrier designed to prevent outsiders from accessing our servers, and we have implemented technology to detect intrusions.  In addition, we protect your Personal Information from unauthorized physical access by storing your Personal Information in a controlled facility.  Except as provided elsewhere in this Privacy Policy, we limit access to Personal Information in electronic databases to those persons (including employees and contractors) who have a business need for such access.  Lastly, we conduct periodic internal audits and vulnerability scans to ensure compliance with these security measures and generate security incident logs that track information useful in screening for attempted abuse of or unauthorized access to your Personal Information. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure.

6.  Privacy Policy Updates and Notification.

We reserve the right to modify this Privacy Policy at any time.  If the Privacy Policy changes, the revised Policy will be posted on the Twigtale Site and we will change the “Last Updated” date at the top of this page to reflect the date of the modification.  Please check back periodically.  Any changes to this Privacy Policy will become effective upon our posting of the revised Privacy Policy.  Use of the Twigtale Services following such changes constitutes your acceptance of the revised Privacy Policy then in effect.

7. International Use.

The Twigtale Services are controlled and operated from within the United States, and are not intended for use outside of the United States.  We do not represent or warrant that the Twigtale Services, or any portion thereof, are appropriate or available for use in any other jurisdiction.  Those who choose to access or use the Twigtale Services from outside the United States do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules, and regulations.  We may limit the Twigtale Services’ availability, in whole or in part, to any person, geographic area, or jurisdiction we choose, at any time and in our sole discretion. Further, if you are located outside of the United States, the Personal Information you provide to us will be transferred to the United States. By submitting your Personal Information, you consent to its transfer and storage in the United States and its use in accordance with the purposes for which it was collected.
